Plain English summary: Use NotifyHero responsibly. You own your data. We'll keep the service running reliably. If you leave, you can export everything. No surprises.
1. Acceptance of Terms
By accessing or using NotifyHero ("Service"), operated by Bring On The Good, Inc. ("Company", "we", "us"), you agree to these Terms of Service. If you're using NotifyHero on behalf of an organization, you're agreeing on their behalf.
If you don't agree, don't use the Service.
2. Service Description
NotifyHero is an AI-native incident management platform that provides:
- On-call scheduling and escalation management
- Intelligent alert routing and notifications
- Incident lifecycle management
- Status pages
- Postmortem and analytics tools
- Integrations with monitoring, chat, and ticketing tools
3. Account Responsibilities
You are responsible for:
- Providing accurate account information
- Keeping your login credentials secure
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access
We may suspend accounts that violate these terms or pose a security risk.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to send spam or unsolicited messages
- Resell or redistribute the Service without written permission
- Upload malicious code or content
- Violate any applicable laws or regulations
5. Pricing & Billing
- Current pricing is available at notifyhero.com/#pricing
- Subscriptions are billed monthly or annually, depending on your plan
- Payments are processed securely via Stripe
- Price changes will be communicated at least 30 days in advance
- You can upgrade, downgrade, or cancel your plan at any time
- Refunds are handled on a case-by-case basis — contact support@notifyhero.com
6. Free Tier
The free tier is provided as-is with no uptime guarantees. We reserve the right to modify or discontinue the free tier with 30 days' notice.
7. Data Ownership
You own your data. Period.
- All incident data, configurations, schedules, and content you create belongs to you
- We do not claim any intellectual property rights over your data
- We will never use your data for purposes other than providing the Service

8. Intellectual Property
- The NotifyHero platform, brand, code, and documentation are owned by Bring On The Good, Inc.
- Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service
- Feedback you provide may be used to improve the Service without obligation to you
9. Uptime & SLA
We strive for high availability across all plans:
- Enterprise plan: 99.99% uptime SLA with service credits for downtime
- Pro plan: 99.9% target uptime (best effort)
- Free plan: No uptime guarantee
Scheduled maintenance windows will be communicated in advance and are excluded from SLA calculations. Details of the Enterprise SLA are available in your Enterprise agreement.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, special, or consequential damages
- Our total liability is limited to the amount you paid us in the 12 months preceding the claim
- We are not responsible for third-party service outages that affect integrations
11. Indemnification
You agree to indemnify and hold harmless Bring On The Good, Inc. from claims arising from your use of the Service, violation of these terms, or infringement of any third-party rights.
12. Termination
By you:
- You can cancel your account at any time from your account settings or by contacting support
- Upon cancellation, you have 30 days to export your data
- After 30 days, your data will be permanently deleted
By us:
- We may suspend or terminate accounts that violate these terms
- We'll provide reasonable notice unless the violation requires immediate action
- In the event of termination for cause, no refund will be issued for the remaining subscription period
13. Data Export
Upon cancellation or termination:
- You can export all your data in standard formats (JSON, CSV) for 30 days
- We'll assist with data migration upon request
- After the export window, data is permanently deleted per our Privacy Policy
14. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Delaware.
15. Changes to Terms
We may update these terms from time to time. We will:
- Notify you via email at least 30 days before changes take effect
- Post the updated terms on this page with a new effective date
- Continued use of the Service after changes take effect constitutes acceptance
16. Severability
If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect.
